00:00:00,000 S1: Okay. Thank you everybody. Um, welcome to the Monday, July 6th, 2026 meeting of the Windham Zoning Board of Appeals. Um, I'm going to identify that this is a virtual meeting, and we are recording the, um, are recording it. Uh, I am Rick Modzelewski, the chair of the zoning Board of Appeals, and I'm joined by my two colleagues. And you could introduce yourselves. 00:00:26,280 S2: Hi. Uh, Kelly Schmidt, CBA, um, committee member. 00:00:31,079 S3: Uh, Amy Cooper, CBA member. 00:00:33,640 S1: Thank you. And, Margaret, since this is a continuation, we're not actually reopening, 00:00:41,039 S1: right? 00:00:41,520 S4: Correct. It's just a continued. 00:00:43,479 S1: Right. Um, so I want to make sure procedurally, I get this right for the Gordon crew, but to continue the meeting. Uh, do you want to kick that off for us, or do I need a motion to continue it again? 00:00:58,359 S4: No, no. You're good. It was a motion to continue at the. Well, the last meeting. Um, I was there. Uh, unfortunately, none of the board members could show up. So on that night, I did record myself. Um, just, uh, announcing that the meeting was being continued to tonight at this time, date and time. 00:01:18,469 S1: So perfect. Yeah. 00:01:20,870 S4: And the the agenda was posted. 00:01:23,310 S1: Perfect. So I'm going to hand it over to the applicant. 00:01:29,590 S3: Hello. Um, I'm going to just kick it off on behalf of Gordon College. Uh, my name is Debra murai. I'm with Accenture Infrastructure and Capital Projects, where the owners, project manager for the project. And, um, I'd just like to have those of us here from the project team introduce themselves. Chris. 00:01:51,950 S5: Uh, Chris. The man. Gordon. College campus planner. 00:01:55,510 S3: Amanda. 00:01:57,540 S6: Amanda Geraldine, project manager and principal at Epson Jocelyn Picardie Architects. 00:02:03,420 S7: And Jacob Jacob Murray Waterfield design Group with a civil engineer and landscape architect, Seville senior Engineer. 00:02:12,180 S3: And um, I also know I see Weston and Sampson. James, you want to introduce yourself? I know you worked on the peer review. 00:02:20,580 S8: Yeah, absolutely. James Pearson Weston Samson, peer reviewer for the Town of Wynnum Zoning Board of Appeals. 00:02:28,460 S3: And that's everybody I know who's on the call. 00:02:31,419 S4: Um, Deborah, there's a Ryan McSherry. Is that not with your group? 00:02:36,219 S5: Ryan McSherry is the second part of Gordon's, uh, site plan for the, uh, Lane bathroom project. 00:02:44,900 S4: Okay. 00:02:45,580 S3: Thank you. Chris. Uh, Ryan, do you want to introduce yourself? 00:02:52,419 S9: Absolutely. Ryan Carrera from Red Barn Architecture, 810 Martin Street, Essex, Massachusetts. 00:03:00,080 S3: Thank you. 00:03:01,080 S1: Ryan. It's clearly done a few of these by getting his address right out of the chute. 00:03:07,240 S3: So that's all of us. Um, and so we, uh, Amanda has laid out an agenda for us. And after introductions, we were just going to ask, uh, if there were any Zeba comments we want to review first. Then we can talk about the stormwater peer review, um, the site lighting component, and, um, Margaret, the proposed conditions, right, will come up, um, towards the end. So, um, Margaret, do you want to mention any specific or any, uh, the committee want to mention any of the specific comments, or do you want to just jump into the presentation? 00:03:48,719 S4: Um, uh, Debra, it's probably best if you do your presentation first. Okay, then I can tell you what comments we've received. 00:03:56,710 S3: Okay. Perfect. 00:03:57,750 S4: If they're pertinent, well, okay. 00:03:59,469 S3: So I'm going to turn this over to the design team. Um, to, uh, to for the presentation portion. 00:04:09,469 S7: Here. I can share this. Uh, share the screen here. Margaret. 00:04:26,029 S1: Um, there you go. 00:04:27,990 S7: You guys see it? Okay. 00:04:30,750 S1: Yep. 00:04:31,029 S3: Yep. 00:04:32,069 S7: I can go through this just very briefly. Uh, this is Jacob speaking from Waterfield Design Group. Uh, the first couple images here are the, um, architectural views of what the building will be. We went through this last time, so nothing has changed here. Uh, in terms of what the building looks like. So it's the removal of an existing courtyard, walkway and landscaped area in place with a new proposed Adam Center for music and associated patios and walkways. The new building is approximately 15,000ft². So this is rendering what will look like on looking north. Looking south. This is south looking north. Um, so just real brief. Existing conditions. The walkways, the existing Philips center, uh, the conservation setbacks, which we can talk about briefly when we get to that part of the project. Uh, new layout with the building taking across the walkway areas. Walkways getting bumped out to make a streamline main campus corridor coming through with different patios in the front, and then also in between the two buildings. Uh, utilities and stormwater. Uh, we've gone through the peer review. I can just talk briefly about that. There were some comments from Western Samson. We addressed those comments. I think the only thing that I really showed much of in the plan is we added a couple more chambers to meet the 25 and 50 year storm requirements, and other than that, there were some more technical details that I won't get into unless necessarily have to. Along this area, I will just say the one item that probably will come up that we said we added to the plans is a note saying that we'll do an additional test pit in the recharge area to confirm that there is no groundwater within four feet of the bottom of the chambers, and we're already at three feet, two inches, so we just need to go another ten inches. That really wasn't plausible when you had the whole campus going on around us, but during construction, that'll be an easy test to dig and confirm. Oh, and then landscaping. We've gone through with conservation and they're good from what we've seen so far from the plantings and everything in the rear. Uh, and then, uh, I'll just say right now, very quickly, we're meeting with conservation on Monday. The really the last item that that from our previous meeting that was outstanding was the peer review and peer review signed off. They were good. So we anticipate that we will get Conservation Commission approval on Monday. Now that we have a clean bill from the peer reviewer, then I'll let Amanda, do you want to talk about the lighting? 00:07:03,480 S6: Yeah, sure. So, um, we received a letter from dark Sky regarding, um, the site lighting and the lighting in the night environment. So in our response, we provided the photometric plan, lighting, cut sheets and lighting schedule. Um, we do recognize their interest in protecting the adjacent wetland and habitat resources. Um, and all of the lighting which is provided for the site, um, currently is designed following dark Sky five principles for responsible outdoor lighting and recommendations. And and see uh pp 4325. The photometric plan shows the light levels on the ground. The new exterior lights will all be downward directed in the high circulation areas, and provide some safe, light conditions in the campus environment. Um, they will be controlled by a digital lighting network, which can be programmed to turn off groups of light late at night, as determined to be practicable and safe. Um, the other concern was the large glazing areas. All of these areas are pointed southward away from the habitat to the north, and they will be provided with interior light control shades, which will be used. So there will be no significant direct illumination on the habitat areas anticipated from the interior. 00:08:43,110 S3: Thank you. Amanda. 00:08:46,769 S7: That's really the rest. We had a, um. Walsh, who's the contractor, provided a, uh, access, uh, planned, showing how they would be able to. During construction. Truck in and out. And this obvious isn't the first project on the Gordon campus. So a lot of these. Are there typical routings for any type of construction project that needs to happen inside on their internal campus roads? And, and then a little more detail of where their staging will be during the project. 00:09:20,970 S7: And with that, that's really the presentation. The college is looking for approval tonight as they're looking to break ground and I believe by August. So. 00:09:31,769 S4: Um, Richard, do you mind if I just have say a couple things? 00:09:36,289 S1: Of course. 00:09:37,169 S4: Okay. Um, Jacob, about that construction route, do you. Where do you anticipate those trucks coming from? Mostly 128. Well, they won't be going through Wenham. 00:09:49,159 S7: Correct. They'll be coming. 00:09:50,080 S4: Mostly. Okay. That's one of the things we usually like to confirm. Um, just so the board knows. And, uh, the Gordon College people I had sent in memo out to the board with some comments, um, just that, um, we we can condition the, um, the test pit issue. So we talked to our peer reviewer as well as the building inspector about that. Um, and we can I can make a recommendation afterwards. Um, and as James Jacob mentioned, the Conservation Commission has reviewed and should be issuing their order of conditions sometime next week. Um, everything's been dated and stamped by a registered engineer as we requested. The landscape plan was approved by the tree warden. So the tree warden has seen it, and they are comfortable with the landscape plan as far as invasive species and location of plans. And we've already discussed the lighting so the board can discuss or ask for the questions if they need to. Um, just so you know, the plans did go to the police department, um, assessors. We don't need to send it to Water or Board of Health because Gordon College gets their water and sewer from Salem Beverley Water Board. So there were concerns there? Yeah. Lucky. Um, the fire fire chief did finally sign off on these plans. There was a little back and forth with, um, our retired fire captain had a captain had retired, um, last week, so we had not gotten final comments from them. But the fire chief was comfortable with their, um, route for emergency vehicles to get in and out during construction and after. Um, So I think that's everything. Parking is fine. I think everything that you've had to review, we've they've responded to. So that's for this part now. Um, Chris, I know if Ryan wants to talk a little bit about the, um, the, the handicapped bathrooms, unless if the board wants to ask questions on this part of it now, that's fine too, which you can decide. 00:12:06,740 S1: On to ask questions about the bathrooms now or table those until after. 00:12:10,220 S5: If you if you want to start with Adam's questions, feel free to. 00:12:15,259 S9: Yeah. 00:12:18,379 S4: At, um, Adam's questions. 00:12:21,259 S5: If you have any questions about the Adam's Center for music. 00:12:23,700 S4: Oh, the Adam's then. 00:12:25,179 S5: Then we can go back to Adam. Let me go. Go back to. 00:12:29,259 S4: Yeah. If you want to do that, which you can discuss. What? What they just presented and all of the information they have on this portion. And then we can talk a little bit about the bathrooms. You decide. 00:12:38,289 S1: Now, Chris, I spent the you know, again, apologies and thank you for accommodating the board, trying to get everyone situated in the summertime. Yeah. On a on a date is, uh, obviously proven to be difficult. Hence the 430 meeting. Uh, I actually laughed when Jacob said this evening because I was like, it's another one. He's been to a million of these things. It's not actually evening yet. But anyways, um, the plans look beautiful. The building looks beautiful. Um, thank you for being empathetic to dark Sky. I appreciate your accommodation, Amanda, and being thoughtful around the lighting plan. Um, I've got with Margaret, and I think our only comment on, um, the Adams Center holistically is around that final test pit and and working with you all to just ensure that it's something even though it's not, um, uh, foreseen, so to speak, that if if you do find, uh, groundwater levels between that three foot two and four foot space? Um, once those results are reviewed by James, that you'll work with us to, to ensure proper compliance. But I think that's my only comment on the project as of this moment. But I don't want to speak for Amy or Kelly. 00:13:57,480 S10: Yeah, I agree with everything Ritch said. Um, I personally felt that some of the requirements for the dark side were sky were a little onerous. And so I appreciate you, uh, working with that, but I want to make sure that there's no restrictions, uh, correct there. We're just they're they're they're doing wonderful things, but there's no restrictions put on them for the lighting. Correct. 00:14:23,120 S5: So our understanding is the client is conservation Commission will have the final say. They can impose different conditions. What we've asked is again, the dark Sky initiative is still an initiative not adopted by the state, not adopted by the town. Um, and so again, the town can go over and above and apply things. During our last meeting, they talked about having some retroactive, um, policy or some self monitoring, and we just asked for them to to reconsider how feasible that really would be financially, but also from just the how do we how do we measure up against something that's not even established as a standard at the moment? 00:15:04,740 S1: Yeah, Amy, I think my general thoughts on it, our conservation is going to handle that final approval anyways that we're really checking for ordinance compliance. 00:15:14,779 S10: Perfect. I love that for us. 00:15:16,860 S1: Yeah. 00:15:17,940 S2: Yeah. That was sort of my my my take too. I mean, I'm glad that you guys are accommodating for some of these. But then I was thinking about, um, having somebody mentioned that there will be, like, controlled shades Inside the building, which is got to be frightfully expensive. And is that really necessary? Um, is that a necessary? Uh, I can imagine the cost of those. 00:15:45,169 S3: I think Amanda, they're part of the project already. They're not in. 00:15:48,970 S2: They are? 00:15:49,370 S3: Okay. Yeah. They're not in response to this. Yeah. They're. They're pointing out that we have the ability to to do. Okay. 00:15:55,809 S2: There are those that. 00:15:57,649 S6: Require. 00:15:58,049 S2: Them. Okay. Okay. All righty. 00:16:00,570 S10: I think the lighting looks beautiful, and it will look beautiful sometimes to see those lights at night. 00:16:05,210 S2: Yeah. Yeah. 00:16:06,850 S5: That is that is our hope as well. Yeah. 00:16:09,730 S1: Chris, that concludes comments on Adams Center. Unless you have anything else you wanted to share. 00:16:14,330 S5: Jacob, can you go back to the site? Um, the Walsh view that also shows Lane's student center. So if you look to the left of the project work zone, you got the Lane Student Center adjacent to the chapel. Yeah. And so what we're looking at is on the right side of the Lane Student Center, you see a larger, full, uh, built out area, which is where our college bookstore is on the second level and the mailroom down below on the left side closest to where it says Lane. Uh, you have a a student venue, uh, a little cafe area, and we're looking to bump out the building to the left, about 400ft² total. Uh, Margaret, you have a set of plans that's already been through Conservation Commission for a negative determination. They said good luck with the project. Moving on. And so we're really just trying to get the formal site plan approval for, uh, being able to proceed with adding two Ada bathrooms, uh, to the campus, uh, space here. I wasn't sure if, Ryan, you had any other comments that you wanted to share and if Margaret, if you had the plans to be able to pull up, which might mean Jacob needs to stop sharing the screen. 00:17:29,150 S4: Yeah. All right, I have them. Uh. Let's see. There they are. 00:17:35,829 S5: So again, everything in Wenham is within the 200 foot buffer zone. Uh, so they they went through and looked at that, um, site plan. Uh, that last one actually is a pretty. Yeah. 00:17:48,509 S4: So it's right there. 00:17:51,630 S5: So there's an existing patio there that just gets bumped out. Uh, it's outside the 100 foot buffer zone where you see that line. Uh, right to the the top there. Um, and then the walkway gets extended there. So again, we maintain our same, um, existing. It's a pedestrian path. Uh, emergency vehicles use it for circulation as needed. Um, and if we can go to one that shows the interior layout. Um. Keep going. 00:18:25,740 S9: Yeah. Almost there. 00:18:32,900 S4: Okay. 00:18:34,180 S5: So again, the considered a minor addition, but the way the Wenham code is listed because it's an exterior addition, it needs formal CBA approval. So Rich wanted us to pass it through you. 00:18:47,180 S9: Yep. 00:18:48,339 S4: Is that it? 00:18:49,819 S5: Um, it's similar to this. It's it's. I think you've got an old one. 00:18:56,819 S9: I think so too. I can share my screen, if that's helpful. 00:19:00,700 S4: Yeah, sure. 00:19:04,180 S5: Yeah. We did some value engineering and just dropped it down to two bathrooms. 00:19:07,700 S4: Oh, okay. 00:19:08,579 S9: Yeah. 00:19:09,099 S5: And then we went from the the beautiful curved patio to straight, uh, court, uh, concrete forms as well. So. 00:19:18,859 S9: So, yeah, in this view, the bulk of the lane center is over here on the right hand side of page. The chapel is over here. Off. Paige left, and our addition here is about 22ft, four inches out from the face of the building by about 23ft in this dimension. Here, we'll have a completely accessible, uh, entrance on this side over here, as well as access to these two bathrooms, uh, two new bathrooms here on the side of the building. And 3D rendering. Here's the existing building here beyond. And our little addition on this side of the of the building over here. 00:19:52,450 S5: So it fits in with the character of the building, um, reviewed with Rich, um, and uh, fire team before and again considered a minor project. No, no main concerns. 00:20:07,450 S1: Uh, Margaret, were there any other comments from any of the departments on the expansion? 00:20:12,650 S4: No, no one had comments on this. Um, and the building inspector was comfortable with it. 00:20:18,490 S1: Great. I have no comments on it. 00:20:27,390 S4: Which we had come up with a few, um, conditions. 00:20:32,150 S1: Yep. 00:20:33,069 S4: Uh, Deborah, there there are different than the ones I sent you last week. I think we just had to make a little amendment to them. So if you want, I can bring that up. Um. 00:20:46,869 S4: I can put it up on the screen. These are these are our recommended conditions, and I don't think they've changed since we spoke last. 00:20:55,069 S1: Sounds good. 00:20:55,910 S4: Uh, Rich? Let me just see. 00:21:04,029 S4: What's that? 00:21:09,670 S4: Okay, so, um, I spoke with the building inspector, and he recommends that the language for this is that he may issue a limited building permit for the site work the test pit um and foundation work, but then no further work will be allowed until we get the, um, confirmation that the test pits the groundwater was suitable. Um, and we'll have that. We have it reviewed by our peer reviewer. 00:21:40,859 S3: Jacob, do you have any concerns with with this? Because I haven't seen this before, so. 00:21:52,980 S1: Yeah. Jacob. I'm sorry. 00:21:55,099 S7: Um. 00:21:59,579 S3: Just in terms of the timing. I mean, I think that we will probably be requesting a site work building permit anyway as part of an early package. So there's. That doesn't concern me. Right? But, uh, I think it should be fine. 00:22:16,339 S7: Yeah, it'll be done early on. I mean, you want, uh, we'll want Walsh to get set up. We don't want to, uh, but once they've got the fencing up, when they once they've got the site kind of cleared. And it's usually best if they actually kind of take the topsoil and the, uh, brickwork off and stuff, and then, then we can use just. 00:22:34,369 S3: Yeah. So that'll be part of that. So that. Yeah, I understood. Thank you. 00:22:38,089 S1: Just saying from a timing perspective that it will work for you all to ensure that the the test pit, the boring comes back as yep as we thought. But you still have the ability to start work. 00:22:51,529 S5: Yeah I guess Deborah, from a layout perspective, again, we're looking for the site plan, approval for foundation and steel to start to be ordered. Um, and things like that. Really, if, if any test pit reveals anything negative, Jacob, you would go back and rework your stormwater, but the rest of the building design and things like that would not materially change. 00:23:16,049 S7: Correct? 00:23:16,640 S5: So I guess that's that's the question. And the language of no full building permit. Again, it wouldn't be full building. You would be applying Deborah. Separate for the structural slash ground. 00:23:30,400 S3: Um. 00:23:31,240 S5: Just I'm not sure there's not a language semantic thing that then turns into some awkward delay. 00:23:36,119 S3: Yeah. So first of all, he says meh. Right. So that's good because we're not, I think, putting ourselves in a corner. It would be good to talk with the, um, building inspector about this, the determination about the early bid packages and how many how they're broken out isn't determined yet. Right. So it may be a, um, site work and something else, or it may just be a site work. Right? So, um, I think having this language have a little bit of, uh, wiggle room if the building inspector agrees and changes his mind and he doesn't, that's what would be helpful. And I think that the May is help. That's the way I read it, is by having that word. Building inspector may issue. I think if we have a conversation and we end up having a permit, that's site work and something else, then he maybe, you know, he that might be fine with him. So that's why I. Okay. 00:24:34,109 S4: Yeah. The way that Rich described Rich Maloney described it as rather than us saying, well, you can't get any building permits until you get that test pit done and you give us the new, um, stormwater if we need, if you need it and has to be reviewed this way. He's a he and this is how he said he usually does it. He gives a limited building permit for certain kinds of work. And he added the foundation test pits and any site work. So he'll give you that initially. And he would be doing that anyway. He said that's how he typically does it anyway. So we just added this. That gives you the ability to go in there, get set up, Get your machines in there and get started on that. And then you can get in and see what that test pit looks like. And then find out that the stormwater system has to be redesigned. Then you just need to give us the new design and we'll have James review it. 00:25:30,259 S5: I'm satisfied with that clarification. 00:25:32,259 S2: Okay. Yeah. 00:25:34,019 S4: Um, and then the next one was the final inspection or occupancy permits. Deborah, I think you were going to look at this, too. Um, so it's often we don't have the staff or the manpower to be on top of this project consistently throughout. So we want to make sure that your engineers know that their stamp and they're going to say to us, we know this was built in accordance with the approved plan. So Rich likes to do that just so that everybody's, um, knows that this is being done the right way. It saves. I think it saves us all having to oversee the project from every perspective. We don't typically oversee these stormwater systems as they're being built. 00:26:25,720 S3: Yeah. My comment was that, um, final as built plans. The affidavits are fine. That's standard. Except I think we were told by the building inspector that they don't do affidavits, so. But that's fine. It's it's standard practice to have have affidavits, but the, um, the as built plans, having them for a final inspection, that's the timing of that is what I was questioning now. 00:26:59,559 S4: Okay. 00:26:59,880 S3: Yeah. It's just the timing and and you know, perhaps for the, uh, stormwater. Right. That's happening early. Um, so I don't know, Jacob, if you think there's any issue with that. But I'm saying, for example, the entire building having as built for things that the site work, for example, landscaping that was just done five minutes ago or two days ago when we were going after to get your final inspections. I just that's the part I didn't I wasn't sure the timing of of having all final as built plans prior to final inspection. That's because final inspection is what is needed for an occupancy, whether it's permanent or temporary. Right. Jacob. Sorry. 00:27:45,230 S7: Yeah. I mean, just from a stormwater perspective, I think the stormwater will be ready to be as built and and to go by the time you're looking for a Co on the building. But you're right that lighting and um, and plantings might not be right. 00:28:01,230 S3: So that's I do think the stormwater portion of it, if that's what the concern is, should be fine. But the the other components of it. Amanda, do you have want to add to that? 00:28:11,819 S6: Yeah. We also would like clarification that the As builds will be by the contractor, not by the designer and engineer team. The final as built. 00:28:21,819 S3: Yeah. And they don't. Yeah. Which is often how it happened. Okay. That it's by them. And so again requiring them as a condition for inspection. Mhm. It's tough requiring the stormwater ones as a condition for inspection I don't think is as Jacob just said is probably not difficult to do. 00:28:45,140 S7: Yes. Yeah. 00:28:47,460 S2: Okay. 00:28:48,259 S5: Yeah. 00:28:49,019 S3: So it's not a matter of not wanting to do it or not. You're not getting them. I just think that in the timing of when we ask for final inspections so that we can get occupancy. 00:28:58,819 S4: Yeah. Yeah. And I think we don't we don't want to tie the building inspectors hands with it either, so that he feels he can't write. Write these. So the final sentence is occupancy permits will be issued, the discretion of the building inspector. We put that in because we know he does have leeway. And this all ends up being up to him, you know, as to what he'll accept. Um, rich, do you feel like we can adjust this a little bit to, um, as built plans for the stormwater system? I think that's what our biggest concern here is that we make sure that we get that final as built for the stormwater system. Um, you know, stamped by the, um. 00:29:49,490 S4: The engineer. 00:29:50,529 S1: Yeah. It's I, I don't want to speak for Rich in his process. Um, generally, you know, I understand that from a staffing perspective, we don't have people to sit out there and make sure that the job is being done in accordance with the plans. Um, so I don't want to put, uh, I'm okay with modifying the language a little bit to sort of make it work workable for everyone. But I also don't want Rich put in the position without his input that, yeah, he feels like he doesn't have enough information to grant. Um. 00:30:31,519 S3: So, Margaret, did this language come from your side or come from Rich? 00:30:36,960 S4: Uh, rich and I worked on it together. Okay. He read it over for me today, and, um, he said he was. He was good with it. 00:30:45,680 S3: Did he initiate this language about the. I'm just trying to figure out if it came from the. If that language came from him. 00:30:52,559 S4: Yeah, he initiated it. 00:30:54,240 S3: Okay. 00:30:55,240 S1: So what do you think the delta of time. Deborah is between final receipt of as built and CEO uh requesting requesting CEO. 00:31:13,710 S3: Well, I just think that, you know, you're often you're requesting. Fine. I'm talking about, like, you're requesting final inspections. You know, your people are going through the building, making sure the fire alarm works, making sure you know all the things that they have to do. Final inspection for. Well, and that there's active work happening up until you know that point. So I think as bills come in, I don't know, a month maybe after, um, or I'm just trying I'm just throwing that out there. And that's why I think my response to Margaret was that, um, was to suggest that maybe there be. 00:31:49,670 S1: The maybe. 00:31:50,430 S3: Whatever occupancy. 00:31:52,069 S1: I was going to say with temporary occupancy suffice. 00:31:54,990 S3: Yeah, we've done that tons of times where a temporary occupancy permit is issued for 60 day, 30 days, 60 days, whatever the building inspector, until you satisfy the the remaining conditions that they want. And then you you have to keep going back right to it until you see you have your final occupancy. So it holds the, uh, the owner, you know, responsible to make sure that they follow up on those things. 00:32:21,890 S5: And that's been his practice with other projects, even the fabrication lab build out of, you know, conditional occupancy while they they do the punch list and final inspections. So, so rich has been great to work with. 00:32:35,329 S1: Yeah. Margaret I'm I'm comfortable that that provides rich enough flexibility and the college enough flexibility to contemplate a temporary occupancy permit until as complete. Unless you're seeing around the corner that I'm not at the moment. 00:32:54,490 S4: No. So do you want me to add something in here, a Deborah that says, um. 00:33:03,559 S11: I would say. 00:33:04,160 S3: Final inspection or or occupancy. Uh. 00:33:10,880 S1: I think you might need to add two sentences. I think, um. 00:33:19,319 S1: Maybe it's maybe if we just modify the last sentence to say, um, a, uh, a temporary occupancy permit may be issued at the discretion of the building inspector for, you know, 90 days prior to as built as being complete, like, whatever that. 00:33:41,200 S4: Mhm. 00:33:42,839 S5: Yeah. 00:33:43,480 S2: Could you put a timeline around when the estimated as bolts be produced. 00:33:50,319 S1: It's 60 days is going to be enough. Deborah. 00:33:53,920 S11: Yeah I mean. 00:33:55,559 S3: I think it's 60 days, but. 00:33:59,789 S3: Yeah. I mean, I think it would be good to put more because sometimes that happens. Um, and, but they also have the ability to issue another temporary if, you know, that's their discretion. 00:34:10,110 S11: Yeah. I think even. 00:34:10,909 S5: Just leaving it just a temporary occupancy permit satisfies it, because again, it just reinforces that he has the authority to issue and or revoke. 00:34:19,150 S11: So okay. 00:34:20,150 S4: So I could say a temporary occupancy permit may be issued at the discretion of the building inspector prior to submission of final bill plans. 00:34:30,869 S1: Yeah, I think that suffices. 00:34:33,349 S11: Thank you. Yes. Thank you. 00:34:36,989 S7: I know we asked it briefly before, but, uh, does the town accept the as builds? Are those typically contractor as builds or are they looking for. Well we can I can only speak to stormwater and civil, but uh, we oftentimes provide affidavit. But they're also based on site visits as well as the contractors as built. Just make sure that's. That's suffice. 00:34:58,460 S4: Yeah. I think for the stormwater, they would be looking for yours, Jacob. For engineering as built. And then the con the contractors. Right. Do the the buildings. 00:35:11,099 S6: Yeah I think the language if you had the final as built plans by contractor and affidavits from all designers and engineers that we would be comfortable with that language. 00:35:21,019 S2: Okay. 00:35:24,019 S4: Um, from the developer. Is that what you calling them? 00:35:27,099 S1: No. 00:35:28,019 S4: From contractors. Okay. 00:35:34,980 S4: Okay. 00:35:38,940 S1: Probably contractors. 00:35:43,260 S4: Contractors. Okay. More than one. 00:35:48,900 S4: Okay. 00:35:53,090 S1: And the third was related to construction activity timing. 00:35:57,210 S4: Yeah. Chris, you said you guys were okay with this seven times. 00:36:01,130 S5: I looked at it and then again, any expectations or any exceptions through written approval? Deborah. Any concerns with that language? Pretty standard. 00:36:10,730 S11: Yeah. 00:36:11,730 S4: And you don't you don't work on Sundays, right? 00:36:14,730 S5: Typically not. Um, and then again, um, as Deborah mentioned before, as we get into the second year of the project, most of the work will be interior. So less concerns for our adjacent students or any distant a butters, etc.. 00:36:32,250 S11: Okay. 00:36:34,449 S4: Yeah. So that was really all that we had recommended for conditions. 00:36:45,489 S1: Deborah. Satisfied? Timing. Perspective. Everything. Okay. All right. Margaret. Um, any other commentary? Are there any other members of the public? I guess I have to ask. I don't see anybody but any other members of the public that would like to comment on the project. 00:37:06,320 S1: Am I speaking myself? Is there any. I don't think we got everybody here. 00:37:09,920 S4: No, I don't see any. I don't see any hands raised or there is no, no other people on the, um. 00:37:14,920 S1: Okay. All right. 00:37:16,800 S4: Uh, I just I would just mention if you do make a motion to include the, um, the restrooms, the Ada rooms, and you're competing with the plan. 00:37:26,840 S11: Okay. Yeah. 00:37:27,880 S1: Um, yeah, I was just thinking through that in my head. So, uh, bear with me. All for a very long motion. This might take a minute to read everything. Um, but I would like to, um. Motion to approve Gordon College request to expand the existing. Um. Gosh, it's been so long. Student center to include two Ada bathrooms and to approve the site plan for the new Adams Music Center with the following conditions one. That the building inspector may issue. Limited building permit for site work. Foundation test pits. However, no full building permit shall be released until the groundwater levels have been determined to meet regulations and, if required, a revised Stormwater System plan shall be submitted to the Building Inspector in the Land Use Department and approved by the Peer Reviewer two prior to any final inspection or occupancy permits being issued, the developer will submit to Building Inspector, finalized plans from the contractors and affidavits from all designers and engineers, but the project has been constructed in conformance with the approved plans. This includes, but is not limited to, stormwater plans, lighting plans and all our architectural and site plans. The temporary occupancy permit may be issued at the discretion of the Building Inspector prior to submission of finalized bills. All and number three all construction activities, including the maintenance, start up and operation of any construction vehicles or trucks on site, shall be limited to between 7 and 5, 7 a.m. and 5 p.m., Monday through Friday, and 8 a.m. to and 4 p.m. on Saturdays. Any exception to these limitations shall be through written and specific approval of the building inspector and police department. 00:39:20,010 S1: Do I have a second? 00:39:24,409 S2: Second. 00:39:26,210 S1: Uh, all in favor? 00:39:30,849 S2: Okay. 00:39:31,130 S10: Name? 00:39:31,409 S11: Cooper. 00:39:36,449 S11: Cooper. 00:39:39,690 S1: How do we get everybody? 00:39:40,969 S4: Uh, no, I think Kelly, we didn't hear your, um. Your vote. 00:39:45,480 S2: Yes, I'm Kelly Schmidt. 00:39:48,360 S4: So it's unanimous. 00:39:50,320 S1: Perfect. 00:39:50,960 S11: Thank you. Thank you. 00:39:52,800 S1: Um, and with that, I will motion to close the public meeting. 00:40:00,000 S4: Uh, the the public hearing. 00:40:01,639 S1: Public hearing. Excuse me. 00:40:06,800 S1: Do I have a second? 00:40:08,760 S10: Oh, I second sorry. 00:40:11,480 S1: All in favor? 00:40:13,639 S2: Hi. Kelly Schmidt. 00:40:15,320 S10: Hi, Amy. Cooper. 00:40:16,920 S1: Hi, Rich. 00:40:19,639 S1: Um. Thank you. Um, for bearing with us. I appreciate, you know, you all accommodating some of the scheduling issues. Uh, very much look forward to seeing it when it's built. It looks like it's going to be a beautiful building. 00:40:32,280 S11: Yeah. 00:40:32,840 S5: Thank you for partnering with us on this. 00:40:35,719 S11: Thank you. 00:40:38,239 S2: All right. 00:40:39,559 S11: Bye bye. 00:40:40,119 S2: Bye bye. Thanks. 00:40:41,599 S5: Thank you. 00:40:42,800 S1: All right. I know we've got a couple other things on the agenda, Margaret. And, um, truthfully, I always, when I do read them, raise my hand to say that I read them. I did not read the minutes. If you could shoot those to me, I didn't. I wouldn't even be able to find them. 00:40:58,869 S11: Yeah. 00:40:59,190 S4: So what I realized was the agenda has the wrong minutes on it anyway. So when I. I'll send you all whatever minutes we still have outstanding. And I'll give those to you, um, this week. So I guess all you really need to do is schedule your next meeting, which would be, uh, I think it's August 26th. Is your next regularly scheduled meeting date. 00:41:22,510 S1: Okay. Do we have anything that you see coming down the pipe? 00:41:28,269 S4: I don't I don't think so. Kate should be back. Um, managing the board by then. And I think the only thing that she's thinking of is you've been talking about amending the zoning bylaws about Chickens? Yeah, chickens. 00:41:43,179 S1: So, yeah, I, um. Well, I don't need that to be a reason why we're scheduling or not scheduling to me, I know. 00:41:48,940 S10: I'm going to be away that day anyways. I'm going to be a vacation. Okay. And out of the country. 00:41:56,179 S11: Yeah. Right. 00:41:57,539 S4: Yeah. Right now I don't have any other applications for the CPA. Um, if they got something into us. Oh, no. Today's only the sixth. I'm sorry. Your actual next meeting schedule is for July 22nd. That's your next meeting date? Um, I mean, like I say, right now, we don't have any applications for you, so we don't have to schedule anything. And if you want to just leave it for August 2nd, if I get an application between now and a certain time, I can let you know. And we can schedule a hearing date that's appropriate. 00:42:35,579 S1: That would be. 00:42:36,179 S11: Fine. 00:42:37,139 S2: With that. 00:42:38,019 S11: All right. 00:42:38,699 S1: Well, you said you don't need me. You're out of the country on the 26th of August. 00:42:41,969 S10: Yes, yes. 00:42:44,369 S1: Um. 00:42:45,969 S2: I'm around, but we wouldn't have enough. Right. 00:42:48,610 S1: Are we. Are you in one or what? Are you out the whole week? 00:42:52,449 S11: Yes. 00:42:53,610 S1: Okay. I am also out of the country the week before that. 00:42:57,849 S4: Okay. So you're out August 17th. 00:43:00,769 S1: Do you want to do it right after labor? Is Labor Day is late this year correct? 00:43:04,570 S11: Yeah. 00:43:05,889 S1: Before Labor Day weekend. Wednesday the second. 00:43:10,170 S10: That works for me. 00:43:11,969 S4: Um, we actually have open space meets on the second. Could do the third two. 00:43:19,289 S1: Yeah. That's cool. Let's go in the other direction. 00:43:21,730 S4: No, I. Yeah. 00:43:22,889 S11: Honestly, I think. 00:43:24,289 S4: You should probably stick to your regular meeting schedule with the, which is the fourth Wednesday of the month, and you don't have to meet in July or August. And like I say, if something does come up, I can work it so that we can find a date that works for all of you before we schedule anything. 00:43:42,590 S1: So what are you saying? To schedule it to September 23rd. 00:43:45,630 S4: Yeah. So sort of wait until, um, September 23rd. And. Yeah, if, like I say, if something comes up, I'll let you know and we'll schedule it and it will get posted and everything. So yeah. So technically right now you can say your next date for meeting would be September 23rd. 00:44:04,269 S1: I'm good with. 00:44:04,909 S11: That. 00:44:05,510 S4: All right. And I'll let you know if I need you. 00:44:08,349 S10: And I may have found another member for us guys. 00:44:11,190 S11: Yeah. 00:44:11,909 S1: Good on. 00:44:12,389 S11: You. Great. 00:44:13,510 S10: And he lives in Tony for Harry's old house. 00:44:16,190 S2: Oh, I've met him. I haven't met him, but, um, our our group went over to meet with him. 00:44:21,550 S11: Oh, gotcha. 00:44:22,670 S2: Because he had some water damage. 00:44:26,590 S1: Um, I don't have anything interesting to share. Okay, that is zoning related. 00:44:36,739 S4: I'll get this decision written up probably tomorrow sometime, and I'll send it to you through sign now, so I'll sign it that way. 00:44:45,380 S1: Perfect. 00:44:46,420 S10: Awesome. Thanks for your help with all of this, Margaret. 00:44:49,619 S4: Oh, yeah. Thank you. I'm sorry. 00:44:51,179 S11: It's good. Thank you. 00:44:53,059 S4: It's been a little confusing, but I think we got there in the end. 00:44:55,780 S1: Get sorted out. I think their plan is there. Everyone is on the same page. They should be fine. 00:45:01,260 S4: Yeah, I think so too. 00:45:02,659 S1: Okay. Awesome. Good to see you guys. 00:45:04,940 S10: Practice, rich. 00:45:06,139 S4: Hey, we need a break. 00:45:07,619 S11: Right? Oh. 00:45:09,860 S1: Uh, a lot of practice anyway. That's why we practice. Um, I will motion to adjourn the July 6th, 2026 meeting of the Zoning Board of Appeals. 00:45:24,659 S11: Second. 00:45:25,659 S1: All in favor? 00:45:29,219 S2: Uh, Kelly Schmidt. 00:45:30,780 S10: Hi, Amy Cooper. 00:45:31,940 S1: Hi, Rich. All right. Thank you. Margaret. Thank you. All good.
