00:00:00,440 S1: Oh, okay. I'm going to open the, uh. Good evening, everybody. I'm going to open the meeting. Um, really scheduled meeting of the Town of Windham Planning Board for on Wednesday, July 8th, 2026. We're meeting together here in Windham Town Hall. It is 7:02 p.m.. We also have a zoom meeting. And I see there are people on the zoom. Um, and the meeting will be electronically available via the zoom link, and it's being recorded. So, uh, and of course there's always minutes prepared. So we have the first item as a continued public hearing on the petition of Select Energy, uh, 91 Grapevine Road. Uh, on behalf of the town of one of the site plan, approval of the special permit under Windham zoning bylaw to allow for a large scale ground mounted solar voltaic installation at 91. Grapevine map 31, Lot. One. One. A. On the iron rail property. Um, Margaret, I don't think we have everything we need to make a decision tonight on this. Or even to take it up further. 00:01:11,500 S2: John, I think John is here. John, did you want to present to the board tonight for sports? 00:01:17,819 S3: No, I'm happy to answer questions. 00:01:20,659 S1: Yeah, it sounds like we still don't have some material from, uh, National Grid on where exactly? Some of the parts of this are going to go. 00:01:32,340 S4: You guys hear me? 00:01:36,980 S2: I'm sorry. Go ahead. John. 00:01:39,819 S3: No, I think somebody else was trying to speak there. I was just about to. 00:01:43,500 S4: Yeah. This is Stuart Clark. I'm, um, representing select. Um, I just wanted to start by saying that, um, we know that the, uh, Interconnection agreement isn't quite set yet, but the site plan review and we're reviewing the site plan and I believe it could be just a condition of approval. Um, because obviously we cannot get a building permit if we don't have an interconnection agreement. Um, with Ingrid. 00:02:22,449 S3: Yeah. And I, I would add that I would simply, uh, this is John de Monica. Thank you. Stewart. This is John de Monica. The only thing I would add there is we do have conditional approval from National Grid. We just don't have their final Isa. So you know nothing about the site plan changes. The point of interconnection is as it's designated and as Stewart said. Um, if if we could get a, you know, conditional approval, uh, based on that national grid item being finalized from National Grid, then that would be. That'd be terrific. But nothing about the site plan would change the location of the interconnection. 00:03:00,310 S1: Because I my understanding was where we left off was there were there was still not agreement about where the you want to say exactly that piece of this. I don't want to misspeak about it, but there was a piece of the the interconnection line to the street maybe, or. Yeah. 00:03:20,150 S3: Yeah, we call it a point of interconnection and it's been established. 00:03:25,030 S1: I'm sorry, I'm sorry. Can I can I finish speaking, please? Yeah. Was not it was not clear. It wasn't on the plan. We didn't know where it was. I don't have a plan in front of me that shows where it is. So I'm just so that we can do. 00:03:38,430 S2: I was expecting John or Stuart to do their presentation tonight and explain to the board what has changed and the present, these plans to them. 00:03:47,750 S1: And we don't have them. 00:03:49,069 S2: There on the screen. And I had sent them to you via email, but I did not print them out. 00:03:53,469 S4: Well, yes. Um, and I apologize for not being there. I had another meeting in a conflict, so I'm sitting in the car. Um, but yeah, there has been a couple of changes. We're not going across country around that gas pump all the way out in the field anymore. We're going directly to the DPW building. Uh. That worked. Um, that point of interconnection had us switched, uh, the, uh, inverter pad from the east side of the array to the left side of the ray over by the water tank. And then, of course, to run right up to, um, the DPW building, uh, all the, uh, meters and stuff will be mounted on the side of the DPW building. And that's that is what the, uh, their angry interconnection agreement is looking at. Um, so we're pretty confident we have a member, uh, understanding that they're going to issue on that pretty soon. Um, we just would like to get this ball moving, um, and get it built. Nothing else about the array has changed. 00:05:10,399 S2: So, Stuart, the plans that you sent me the other day, um, we were sort of hoping someone would be here to explain what these plans are showing and where the location is for the the lines that you're talking about. Um. 00:05:27,160 S3: That, that last one actually did a good job of it. The note one after that you showed with the the combiner. No, you had one. There you go. There's the there's the. Oh, I'm so sorry. That's not that's not the combiner lines. 00:05:45,000 S3: You have lines coming, coming off the arrays. Yeah. 00:05:49,000 S4: Right. Right there. You can. Can you guys hear me still? 00:05:53,060 S1: Yes. 00:05:54,500 S4: Okay. You can see the water tanks right there. That's the circular thing on the left. Uh, left side of the screen. Right. That's the water tank. Um, the combiner boxes are. Uh, I've, I think row one. Uh oh. Maybe I, I labeled them a through B. Yeah. Um, so it's on the last row. Row? F I think it is right off the end of that is where the combiner boxes are, and they go directly up the hill to, uh, the DPW building. 00:06:30,019 S1: The existing utility building is what is marked. 00:06:32,620 S4: Yes, exactly. And all the all, all the meters and everything you can see are called out for right on the side mouth on there. Um. That's all underground. Um, trenching for for each array. 00:06:51,439 S1: Okay. And then? 00:06:53,639 S4: Then just the fence around it. That's all there is to it. 00:06:56,920 S1: Is there not an interconnection with the grid somewhere. 00:07:00,879 S3: At that meter? It's interconnected with the grid. 00:07:06,720 S1: So there's an underlying line to the existing utility building already and it's connecting there. 00:07:13,160 S3: We're no we're bringing a new line in underground from the from the arrays to the utility building connecting at the electrical gear established in that building is where the point of interconnection will be. There will not be anything further. 00:07:29,399 S1: I'm just trying to understand. So the existing building is already connected to the grid somehow. 00:07:34,160 S3: Correct? 00:07:34,600 S4: That's correct. 00:07:35,519 S1: That's what I miss missing because. 00:07:37,639 S3: It has electricity and it's the same electric meter that that, you know, brings up the kilowatt hours as they're consumed in that building for lights and pumps and other. 00:07:46,120 S1: Purposes. Yeah, yeah, yeah. So I had thought that there was still a piece of this that was meant to show how it was going to connect out to something on the street, but that doesn't sound like the way you're handling it now. 00:08:00,149 S3: It connects. It connects through the gear electronic here in that building. 00:08:07,230 S1: So the information that we're missing then is because you had said the cell and. 00:08:13,589 S2: We were waiting for the confirmation from National Grid that you had been. 00:08:18,149 S3: Provided conditional approval of this plan. But it's not past all of the T's and I's daughter to give us what we call an interconnection services agreement, which is the final part of their granting approval. And as Stewart mentions, we can't we can't put a spade in the ground until we get that. So we would love to get a conditional approval based on them granting that which they've already they've already verbally said it is conditionally approved. So yeah, I think that process. 00:08:47,389 S1: The disconnect there was. They couldn't say in the materials we looked at the last time. They couldn't say whether something on the ground here would have to change. Something about the site plan would have to be changed before they could approve it. So if we gave you a conditional approval and they came back and they said, oh no, no, no, that all has to change. Right? Then you'd have to come back to us for another approval. 00:09:11,330 S3: Correct. But if they don't say anything. Yeah, but if they don't say that there's any of those substantial changes and they say, yep. As, as we've been discussing, has we told you verbally the point of interconnection you have established it's fine. Good to go. Here's your interconnection services agreement. And at that point, we would be able to start building the project with, with. 00:09:34,210 S5: And have they. 00:09:34,889 S3: In coordination with the town. It should have been this week. They told us by the seventh, but that didn't happen. So it's just typical National grid. 00:09:44,450 S1: Did you have a question? It was more of a comment. It's I don't think we can give a conditional. 00:09:51,000 S6: Approval on this if it's contingent on National Grid potentially changing what we're looking at. 00:09:58,120 S1: That's what my. Yeah. 00:10:00,200 S6: I mean, what we have is an incomplete application. As far as I'm concerned. 00:10:05,519 S4: So don't let me let me handle this, John, the way you're what we're asking you to do is approve the plan as presented to you. If we have to have that plan change, we have to come back to you. So, um, you can approve this plan as as presented. Um, and if there's any changes that are material, um, like, they want us to go back to that other poll, then we'd have to come back in front of you for modification. 00:10:34,679 S6: So who determines that? 00:10:36,320 S1: The materiality. Who's going to decide whether it's material or not? 00:10:40,559 S3: We'll provide the copy of the final Isa that's provided by National Grid. We'll provide that directly to you. 00:10:46,740 S4: Right. And if the Isa tells us we have to move it, then we would, um, ask the board if they consider that a major change or a minor change. And if we had to reopen the public hearing or if we could just do it administratively. 00:11:12,460 S1: Anybody else on the board have thoughts about this? 00:11:17,059 S1: Oh, yeah. I would like to wait till August. Honestly, that would be my gut, but I'm open to other ideas. 00:11:28,779 S6: I'm on the same page. 00:11:31,740 S1: With. 00:11:32,259 S6: Waiting till August. 00:11:33,740 S4: Can I just plead with you one more time? We can hold on. Hold on. 00:11:37,620 S6: Hold on one second. Let's. We'd like to hear from other members of the board. 00:11:41,379 S4: Okay. Sorry. 00:11:46,519 S6: I'm disappointed. You know, I can't remember when we start talking about this. It was like rush, rush, rush rush rush. Everything was coming in at the last minute. Give us approval. Here's the pool with all the ducks in a row. Went to town meeting. And then we get this now, two days before today. Rush rush rush. Let's get this done. Conditional approval. That being said, uh, you know I don't like that. You know, how do I put this? 00:12:27,000 S6: I don't want to penalize the applicant because National Grid moves slowly, right? And I don't think that's that that I don't that doesn't feel good to me. But a conditional approval always makes me nervous. Like it's either ready to go or it's not. And if it's not ready to go, There has to be a really compelling reason that I think we would do a conditional approval. And if there's some type of tax deadline, project deadline, that's something that says that if there isn't, like there's a conditional approval tonight, uh, x y, z consequences is going to follow tomorrow. I would be sympathetic to that. But if it's just we wanted today so we don't have to come back in August. I don't know that the I don't know that it's appropriate for this board to stick its neck out that way. Um, particularly given the fact that this is a marquee site and open to discussions that some of us have been participating in about what's going to happen to this, this site. Um, this is a big deal for this town, and this is a part of it. So that there's I don't think I think we want to be careful of anything that happens in our iron rail. That's a full thought and probably not helpful at any point. 00:13:45,210 S1: I know it's been perfectly helpful. Thank you. 00:13:52,250 S3: That is, you know, you know, Mia culpa for having not having everything lined up and not having National Grid's final approval on it. We're just trying to deliver savings to the we want to get the project built to the town and start enjoying the savings that come from the project. 00:14:06,450 S1: Yeah, and we totally appreciate that. Um, and the purpose of the project and. 00:14:14,850 S1: I guess we want to make sure we're not treating the town any differently than we treat any other applicant in this kind of situation. And we would in this kind of situation, we want to complete application before we voted on it. 00:14:26,570 S6: So so I'm sorry I came in late and I must have missed this. Is this now a town application? 00:14:32,850 S1: Well, it is on the part of the town. Yeah, it's on the part of the town. 00:14:37,610 S2: It's. It's a town application. but we've been advised by town council to treat it as a private application. 00:14:44,950 S6: The private is not in town. 00:14:46,710 S1: But the. 00:14:47,110 S2: Owner is not. 00:14:47,990 S1: In town. 00:14:49,190 S2: By the town. 00:14:49,870 S6: Okay. But there's I think in the bylaw, there's specific language that if it's a town project, it has experience in town. 00:14:55,870 S2: It is. But town council advised us not to treat it differently. 00:14:59,669 S6: Okay. And I would ask the applicant is there what is the consequence of to the project of not getting conditional approval tonight? 00:15:11,750 S3: Just delaying your enjoyment of the savings. 00:15:17,789 S1: By three weeks. 00:15:19,029 S6: But there's no there's no tax. 00:15:22,350 S3: There's not the tax. We I'm going to provide a super brief aside, there has been an enormous amount of activity in our industry over the course of the past year since the passage of the One Big Beautiful Bill act, the one year anniversary of which was just July 4th. Most of that activity has been around purchases. Our organization has been has been unprecedentedly busy in late 25 and early 26, trying to make sure that everyone could enjoy the federal tax incentives that are available for all projects that are purchases. This is a PPA. We've already made a financial commitment to the project. Therefore, this project is safe harbor for that investment tax credit. It's simply, you know, we've been so massively busy trying to get so many of the municipalities projects under the wire before the July 2nd deadline, when we needed to get everything done before this that, you know, excuse us for, for, uh, you know, not having everything perfectly lined up on this one, uh, at an earlier point, but we've just been, you know, unprecedentedly busy and trying to get everything done. But there is no tax difference in no economic difference in this project, whether it's begun one month earlier, one one month later. We already have this from fully complying with the federal, uh, tax incentives fully baked in. 00:16:46,399 S6: Okay. Thank you. 00:16:53,519 S2: Um, one other item is the idea of the decommissioning bond. Uh, I don't know where we stand with that, John. 00:17:00,720 S3: Yeah. So the decommissioning bond is baked. It's it's it's fully included in the in the pricing of the project. Um, and it begins in year 23. So it's it's existing for the last three years, which is what is most which is what is most commercially done with all of our projects. It's two years for a 20 year project, three years for 25 year project and decommissioning. Bond covers fully the cost of removal at the end of term, and it's fully priced into your project. It has been. It has been. So I guess I know this one keeps coming around, but I don't know what the item really here is because we have been including issues including the decommissioning bond since the get go on this one. 00:17:48,420 S2: I think it's whether the port is okay with that. The idea of it starting in the year 23. 00:17:54,740 S1: As opposed to year 20. 00:17:58,619 S2: It could start any time. 00:18:00,180 S3: We could, we could we could start at any time again. That's a that's a direct cost borne by the project. And it's, it's recognized in the, in the PPA or CPA credit purchase agreement rate that the town will pay for the electricity off the grid. So we can add cost by, by having that bond in place an earlier year. And it's simply paid for within the project. Therefore in your in your CPA agreement, we you know, we do an awful lot of these projects. The overwhelming majority agrees with the logic of two years on a 20 year project, in three years on a 30, on a 25 year project. 00:18:41,009 S3: Contract is very specific about the removal of the equipment at the end of term. 00:18:45,730 S1: And the bylaws require a specific term for these bonds. 00:18:49,529 S2: It does not require a specific term. It just says that something that's, um, acceptable to the board. And I believe the bond was worked out with the Select board on in the agreement, the PCA. 00:19:05,089 S1: Well, this is what I was asking earlier. Is this really in our jurisdiction or is this the rules? It isn't, it isn't. But I got the answer. 00:19:12,490 S6: Well, I thought it wasn't. But the bylaws says the planning board shall require an applicant for large scale ground, as. 00:19:18,809 S1: It should do. 00:19:19,609 S6: To provide a performance guarantee. 00:19:21,730 S1: Right. 00:19:22,329 S6: To cover costs for removal. 00:19:24,490 S1: And looking at town councils. Note, you know, here's a sentence stating the obvious. If the if the ship is abandoned in year ten, there's no bond to cover removal. 00:19:37,390 S1: Um. 00:19:44,990 S1: I just don't feel like I know enough to do anything but say. Sure. Like I said. 00:19:52,029 S7: I think it would just be a question of what the difference in cost is of the different years out. But if the cost is going to go up, if they're holding a bond for 20 or 25 years, I'd like to know what the difference is in those rates. 00:20:03,029 S1: Do you do you have that information? Did you hear that question? 00:20:05,230 S3: I can plug that into our model and provide that back to Margaret, to the board at, you know, upon this request. But, uh, I think we'd previously modeled it and it did have a material impact on the CPA rate when we brought it all the way to like year ten. But I could model that and provide you back feedback. And here's what happens if it kicks in at your five year ten, year 15, year 20 and provide you those various outputs. It's it's just it's a, it's a, it's a plug in a, in a massive workbook. That, that that you know, does it's black box Excel magic and spits out a number. 00:20:45,369 S1: You know, given that question and and and given the question about National Grid, I, I'm still feeling like if we can wait till August and have everything in front of us and really understand what we're doing here, and make sure that all the Byzantine and T's are crossed. I mean, I want this project to go forward, there's no question about that. But I'm I'm also mindful that these are our responsibilities. And if we don't really know it, having a conditional approval is going to bring you back here in August anyway. Why wouldn't we just say, let's get it all together and then discuss it August. So that's that would be where where I am. I don't know if we need to vote on that. Um, you. 00:21:30,039 S2: Would if the board wanted to continue to Augusta. 00:21:32,680 S1: The board was. 00:21:34,400 S7: Excited about. 00:21:36,039 S1: Which if I would move that we continue the hearing until August. If we move it. 00:21:45,960 S1: You know, to the board until we have a complete application, including a little bit more analysis on the bond. Yeah. 00:21:53,839 S2: Um, yeah. I think the applicant would need to agree to the continuance. 00:22:00,880 S1: In writing. 00:22:02,200 S2: Yeah, they can send us a form if they're willing to do that. 00:22:09,519 S4: John's ball, not mine. 00:22:11,200 S3: Yeah, sure. And whatever it takes, we want to get the project, you know, permanent for, uh, for development. So whatever it takes. Yeah. 00:22:20,000 S8: And I'm looking at your construction schedule. Looks like the first thing on the list is site survey and staking, which you're proposing to start on the third. I mean, is that. 00:22:28,940 S3: Was just an indicative. That was just the this was more for the purpose of, of, uh, durations rather than specific dates. But we said, let's start the first Monday in August if we get the approval here. So. 00:22:41,299 S8: Okay. Okay. 00:22:42,299 S1: And we're the second Wednesday in August, which takes us out to 12th to 12th. 00:22:49,420 S4: It's really that a 20 day appeal period. 00:22:54,299 S2: There is a 20 day appeal period for this first review also. Um, there's also the special permit to be considered soon, but once the decisions signed and given to the um on this 20 day appeal period, right where they would issue building permits. 00:23:11,059 S1: Okay. So so August 3rd probably isn't realistic and that's fine. 00:23:17,099 S3: That can easily be adjusted. 00:23:19,339 S1: Yeah, yeah. 00:23:22,579 S1: I mean, short of having a special meeting about this in between, um, If National Grid were to cough up the information and we got more information about the fund. 00:23:33,369 S2: Yeah. And I think it might be helpful if we have either a representative from the Select board or town administrator or Kate come and work through this with you guys a little more to so that you understand what, what the town's doing and they understand what you're trying to do just so it's wrong. 00:23:53,730 S1: I mean, that's fine. I think the concern here is just that we don't have all the information we need to make a decision tonight, and it's been pending since April 24th. So it just feels very like. 00:24:09,329 S2: Yeah, no, I understand. 00:24:11,329 S8: So there's. 00:24:11,730 S1: A motion. 00:24:12,170 S8: And a second I think we have to vote. 00:24:14,289 S1: Yes. There is a motion a second. 00:24:16,170 S2: So the motion is continued to the August 4th meeting date okay. 00:24:21,130 S1: And we've had an oral approval. 00:24:23,650 S6: I just I think to be clear what we need at this, what we need in advance of this August meeting and at the August meeting. And if anyone disagrees, we can speak up. We need someone to walk us through the plans to show what's changed since the last plans that we reviewed. 00:24:43,029 S1: Which they did a little earlier. 00:24:44,430 S6: Which they did a little earlier. But I. 00:24:46,430 S1: But yes. 00:24:47,230 S6: I think we could have like, let's get it done in August. Right? So if someone can show up and say, and you know, it's easier than over zoom, frankly, because you pointed something, we pointed something, we can see what we're both pointing to. We need to have clarification on the bond since we're the we're making the decision. So that maybe is for the applicant. But I think it's really for whoever shows up from town, whether it's an administrator or somebody from the select board who can justify that. This makes sense, even if we're the decision makers on this, I don't feel qualified to make that decision. So I think we need someone here from the town that's prepared to advocate for whatever the proposal is. And the questions are going to be, what's the price difference? Is the town comfortable with this? Who's reviewed it? We got to have that. Someone here to answer that question, whether it's elect board or the town. Uh, and I think generally we just need to do a. Someone needs to do a scrub of the bylaw and make sure that everything is in compliance here is that there's just nothing that comes up where it's like, oh, wait, well, this but, you know, and this and that, let's let's scrub it and let's make sure that the, the package is complete, like a week in advance of that meeting. And let's take action on it. 00:26:10,250 S8: Can we get the information that your spreadsheet will spit out and say two weeks? 00:26:15,730 S3: No problem. Yep. I can have that to Margaret by Monday. 00:26:19,450 S1: Great. And maybe clue Kate into what the conversation's Then tonight I. 00:26:23,680 S3: Yeah. 00:26:24,759 S1: You're going to talk to Kate. About what? We just I will I'll. 00:26:28,119 S2: Pull her in and we'll discuss it next week because she's. 00:26:30,720 S1: The staff person who's really working. 00:26:32,400 S2: Yeah, she's working with, with, um, select on the project so that I. 00:26:36,839 S6: Think also for Kate, if she's able to is just situate what the current plan is in the greater understanding of what is going to happen at this site. Yeah. For the, for iron rail. 00:26:50,279 S1: Yeah. And I actually. 00:26:51,640 S6: It's not that it's going to change the plan that's been presented. It's just help us understand and feel comfortable that it's consistent with what we're expecting to is going to happen with this site coordinated. 00:27:05,519 S1: Okay. All right. So thank you very much for your patience with us. We do need a vote. Um, all in favor? 00:27:15,759 S6: I nine. 00:27:16,759 S1: Weeks. 00:27:17,160 S8: I ask her a lot. 00:27:19,039 S7: So. 00:27:23,059 S1: Okay. Thank you. 00:27:26,500 S2: Thank you. Johnson. 00:27:27,980 S3: Thank you. 00:27:30,900 S1: Let's get comfortable having to do that. But I don't know what else to do. I just don't like giving approvals when we don't really know. 00:27:39,099 S7: I mean, we had three months of no communication. There's plenty of time for an update. 00:27:44,099 S1: I know, so. Okay. So, um, the next item is the seven, uh, 7 to 9 Maple Street. Approval not required. Plan endorsement. The plan is here. I see there's someone from Green Belt. I saw attorney go on zoom. Mhm. 00:28:01,380 S9: Hi. Good evening everybody. Miranda Moscow, on behalf of Greenbelt. Um, just a quick overview here. Um, we were before you in May with, uh, a special permit application to approve, um, the hammerhead lot. That is one of the lots created by this A&R. Um, and the board at that time, uh, granted, the special permit application, um, and uh, determined that the A&R application would be put on hold until the appeal period for the special permit had expired. And also, um, had imposed, um, some conditions and requests that the A&R be updated to reflect, uh, the emergency access driveway, um, that provides access from, uh, lot one B, which is the house at nine Maple Street, um, to and from Maple. Um, so that condition has been fulfilled with a new, uh, stamped plan that's been updated to reflect the location of that emergency access, as well as a related, not related. But we also during this process discovered or the town discovered that there was a water line going through um, the property that was going is being retained by Greenbelt, um, that serves the main house at nine Maple Street. So this plan also shows a water line easement. Um, and I believe, um, I believe that is, is really it? Otherwise, this is the same plan that was approved as part of the special permit, just updated to reflect the fact that the first wave of these closings did actually occur since we last met. Um, so a related entity to Greenbelt, uh, called uh, One Tree LLC, now owns, uh, the property that's being divided. Both, uh, lot one A and lot one B, Um, and the rest of the property was conveyed to Greenbelt and is subject to a CR held by the town. 00:30:25,970 S1: Yeah. Uh, Margaret Miranda. 00:30:28,289 S2: Was, um, lot one a included in that previous answer. 00:30:34,410 S9: Yes. 00:30:35,849 S2: Oh, it was broken into lot one eight. 00:30:38,369 S1: So. Yeah. 00:30:38,970 S9: Well, the I'm sorry, we've had you've had two ANR applications in front of you. The first was to create lot one from the balance of, uh, 7 to 9 Maple Street. So, yeah, that was approved and recorded with the Registry of Deeds. And then we followed on the heels of that with the combined special permit and ANR application to allow this plan to be endorsed. Um, with the special permit. So. 00:31:12,210 S2: Yes. Okay. 00:31:12,890 S9: Yeah. Yeah. 00:31:16,750 S2: Thank you. 00:31:21,190 S1: I don't see any reason why we wouldn't agree to this and sign it. I mean, I can sign it right now. Yeah. 00:31:31,869 S8: We don't have to vote. 00:31:33,190 S2: Yeah, you have to vote, too. 00:31:34,349 S1: Yeah. To vote? Yeah. So I move that we sign approved, approve and sign that, um, A&R for 7 to 9 Maple Street bets presented tonight. 00:31:48,549 S7: Second. 00:31:49,069 S1: Unless you. 00:31:49,910 S8: Well, I was just saying. I think we actually have to approve the in our. 00:31:53,789 S1: It's not required, so we endorse doors. 00:31:57,789 S8: Yeah. 00:31:58,029 S1: Second, the plan is shown. Yeah. 00:32:00,910 S8: A second. 00:32:01,869 S1: Thank you for the language. Yes. You're welcome. Town council here. All right. The motion. And second, we should vote. 00:32:12,349 S6: Marcus In this. 00:32:15,059 S1: Week's. 00:32:15,700 S8: Pastoral. 00:32:16,259 S7: I. 00:32:19,019 S8: Answer a question. 00:32:19,740 S1: That. 00:32:20,539 S6: I have no questions today. 00:32:22,980 S2: Um. Thank you. It'll be fine tonight. And, um, I'll leave it with Kate for tomorrow. Do you want someone to pick it up tomorrow for the Lord, or is it. 00:32:33,140 S9: Yeah, I think, um, Vanessa Johnson Hall from Greenbelt is in the audience. Is it possible for her to take the original this evening? 00:32:41,819 S2: Yes. You can. Okay. Yes. Once they sign it, I'll just beat it. 00:32:46,940 S9: And that would be great. Thank you all. 00:32:53,019 S10: Morning, Brenda. I don't know if you can hear me. I can drop it off of you tomorrow morning. 00:32:58,819 S1: Okay? 00:33:00,140 S2: Yeah, she just said she'll drop it off with you tomorrow morning. 00:33:03,380 S9: Okay, let's, um, let's circle back because I'm on the cape. Vanessa. 00:33:07,380 S10: Not it. 00:33:08,900 S9: We'll we'll circle back and figure out what what the next step is. 00:33:16,960 S9: But thank you, members of the board, for getting that done and for helping make this project a reality. It's it's an excellent one. 00:33:26,079 S1: Very cool. If you want to date it. Or should I do it? I think there's the pen. 00:33:33,240 S1: Where? The cap? The owners. 00:33:37,240 S1: Dave's keeping the cap. Yes, the Catholic cap is right up. 00:33:42,880 S2: These are precious. 00:33:44,000 S1: May not be. 00:33:46,279 S2: I'll just take a photo of it. 00:33:48,039 S1: But, you. 00:33:48,359 S8: Know, staples closed. 00:33:49,759 S1: Yeah, I know right? Yeah. All right. Danvers. 00:33:56,759 S10: Thank you so much. Thank you everyone. 00:33:58,480 S1: Good night. Thank you. You too. 00:34:00,960 S9: Thank you everybody. 00:34:02,920 S1: Thank you. Enjoy the cake. Thanks. The next item is an update on the subdivision regulations. Yeah. So you saw your note? Yeah. I mean, I think there's a tension between oversimplifying and using meaning, and. 00:34:19,659 S2: Well, Council reviewed it. Yeah. I don't know if you all had a chance to read all the edits I had. 00:34:24,980 S8: I read some of the edits. I haven't read all of it's 91 pages of Red line. 00:34:29,420 S1: Yeah, I have not had a chance. I haven't. 00:34:31,780 S2: But I thought the money's worth there, I think. Yeah. So yeah, we need to go through all those and, and at some point decide which ones you'll incorporate and which ones you might not. 00:34:45,139 S1: Do we need a working meeting to do that? 00:34:48,659 S2: I think it's a good idea if you want to do that. 00:34:51,219 S1: Because one of the things I was thinking about when they were worried about the select project is if we needed a special meeting for that could be just bold to select materials and if they were available at that point. 00:35:06,139 S2: You mean if you wanted to have a meeting between now? Well. 00:35:10,769 S1: Technically, I mean, July and August are not great times for an extra meeting, but. 00:35:15,329 S2: And you continue that meeting to a date? Certain. I know, and I know we did. 00:35:19,809 S1: So that was why I didn't bring it up at the time, because I was thinking, I don't know if we really want to have a special meeting in August, so I didn't want them to continue it to a time that we don't know if we really want. So, to be blunt. Right. 00:35:36,210 S2: Um, you you can certainly have a special meeting, uh, for the subdivision regulations, but you really. 00:35:43,969 S1: You really should be that. Yeah, because otherwise it'll be hours long. 00:35:47,369 S8: I have a question about Robin's draft or Cape laws draft. Yeah, she. There were some comments from Robin where she was questioning or commenting on texts that had been added in the red line, which I assumed was added by her office's. That not the case. So why is she commenting on her? 00:36:09,309 S2: I don't know, there were two different people in her. 00:36:11,510 S1: Maybe she hasn't, but I haven't. She's doing it. 00:36:14,710 S8: Sure she does. But yeah. Goes through the comments that came to us. Right. 00:36:18,030 S7: So they'd be clearing their own comments or. 00:36:21,349 S2: They know they may not have spoken about them together. Yeah. 00:36:24,429 S1: Could we ask her to do that and get us another round of that doesn't involve the internal conflict? 00:36:31,190 S2: Um, sure. 00:36:32,510 S8: It was definitely a little confusing. 00:36:35,349 S2: Yeah. Okay. 00:36:36,309 S1: And it might eliminate some of the red lines. 00:36:38,230 S2: Yeah. Let me. I'll go through it. I've gone through half of it already. Um, but I can go through it and just see which ones look like she's commenting on her own, um, associate's comments. 00:36:52,510 S8: So I would just ask her to ask them to do it. Okay. 00:36:55,789 S1: Yeah. Just ask them to just give us one set. Yeah. 00:36:59,590 S2: I wonder if they they did it that way. You know. 00:37:03,230 S1: So we could see. 00:37:04,389 S2: Yeah, we could do a word doc with the comments. You know, you write back and then you comment on that line. You respond to that comment. No, but we don't. 00:37:12,050 S1: We're sending it back out. We usually clean this up. So if there's anything outstanding. The only thing that's important remains, you know. So we're the final decision of the attorneys. 00:37:22,010 S2: All right. Let me take a look at it and let her know. 00:37:24,369 S1: Um, and yeah, and I do think to your point, there's this tension between wanting to simplify it so people understand what it is and simplify it so that it can be taken advantage of in ways that we don't intend, because it loses some legal meaning. 00:37:44,010 S1: In the re hashing, and I think that was from what I looked at, that was sort of where she, her head was when she looked. But yeah, so understandable. It would be helpful to think about it that way. When we look at it, I think, okay. Um, uh, and, and maybe to say that to her, like, could you just focus on what's essential so that we're Not giving away something that we don't intend to. Okay. In terms of giving away, it's the wrong way to put it. But changing the rules in a way we don't intend to, reducing our ability to defend a decision. 00:38:21,280 S2: Right? I understand that. Okay. 00:38:25,239 S1: Thank you. 00:38:25,800 S2: Do you want to, um, schedule a meeting to to have a good working group on that, or do you want to wait until August? There is no rationale for this. We've gotten through the grant. Uh, we sent in our final submission of reimbursement. The grant ended in June. Great. Um, so we spent most of the money and the the grant money is being used to pay for Robin's review, but I can't bill anything after June. 00:38:55,159 S8: I would like to have working group. Okay, but not until at least the end of August or September. 00:39:01,920 S1: Yeah. Yeah. 00:39:03,400 S2: I mean, because. 00:39:04,219 S1: These are for. 00:39:04,940 S2: The town meeting. Um, you know, this this board will have a you have a working group. It can be open to the public or then have another public meeting to kind of present it. Uh, we can do a little bit of, uh, public outreach on the website, and then you'll have a public hearing when you adopt it. But it's just the Atlantic Group. 00:39:25,380 S6: There will be no open seat in the house for them. 00:39:28,659 S1: Yeah. 00:39:28,980 S6: Subdivision one. 00:39:31,340 S2: There won't be one open seat. 00:39:33,019 S1: It'll be one on that. Oh. 00:39:36,380 S8: Yeah. 00:39:37,500 S1: Yeah. That's why. Uh, well, it depends on what the outreach looks like. And if we got a reporter and what they say and. Yeah. Um, okay. 00:39:51,699 S1: So, update on the status of the Penguin home property is the next item here. 00:39:56,739 S2: Yeah, I don't have any. 00:39:57,900 S1: News. 00:39:58,659 S2: On it. 00:39:59,300 S8: Um, have an update. 00:40:00,579 S1: All right. 00:40:01,019 S2: No, I have no update. 00:40:02,619 S1: I mean, it still sounds like it still sounds like Captain Cannon, for instance, the front runner on the. 00:40:07,409 S2: Day, as far as we know. But I have not heard anything. I'm sorry. 00:40:11,849 S7: I thought I heard they're going to put it back out the option because the number wasn't high enough. 00:40:16,050 S2: Really? I didn't hear that, Scott. Although you might have. 00:40:19,489 S7: An article for the week. I'm not saying that is gospel, but. 00:40:23,329 S8: Right. 00:40:24,929 S7: Yeah, yeah. They're unhappy with the, uh, the price. 00:40:28,769 S8: Well, I know there was motion practice about their bid. I don't know what happened, but. 00:40:35,170 S2: We might be a little more in tune to the legal workings. 00:40:39,489 S1: But just having a good conversation amongst us about where it stands and what we can expect. It sounds like it's not anywhere near coming at us. 00:40:48,610 S2: No, I don't expect us to get any applications anytime soon, but, um, as soon as I do find something out, I'll let you know. I reached out to them to Acaba and Forbes recently with an email. I haven't heard anything back to it. 00:41:05,349 S1: Okay. And then the next item is the update on the iron rail property. I think we kind of touched on that a little bit with select. If Kate could come in and just do a little bit about what's happening. 00:41:16,670 S2: That would happen with the working group. Yeah, I think we. 00:41:19,710 S1: Just did one meeting with them and leaving my information, and then I feel like it's been radio silence, but. 00:41:25,510 S2: Well, the group did find, um, sort of ended the meetings and came up with a recommendations to the select board. And I think I'm not sure if Kate's passes on to the select board yet if they finalized, but they're working on those. 00:41:42,190 S1: Well, when she's ready to share this with us, I think it would be helpful. And maybe if she can do it as part of the whole select, you know, like this is one part of it, but then the other part looks like this or what we're thinking could look like, okay, it looks like this. That would be great. So. 00:42:00,329 S2: David, were you? You were working Brooks a little bit, right? 00:42:04,210 S6: Yeah. I missed the last meeting. 00:42:05,769 S2: Yeah. 00:42:06,289 S6: Uh, unfortunately, because I think that's where I was going to go. 00:42:10,210 S1: Yeah, I missed that one, too. 00:42:11,650 S6: I think, uh, they selected kind of a hybrid approach. Mhm. Um, housing up by the cemetery. 00:42:22,849 S2: Yeah. That the housing would go more up behind the cemetery area. Um, and that something like a recreational facility where the current building is the current, I think the current building would have. Yeah. So utilize that for more. 00:42:36,769 S1: Recreation with a soccer field. Stay as they are. 00:42:39,650 S2: Yeah. Soccer field stays. Um, DPW expands a little bit. Um, and whatever goes there might have like a commercial piece to it or retail or something in there. 00:42:52,690 S1: Right. And Boy Scouts, we don't know about the Boy Scouts. 00:42:55,369 S2: I don't think the Boy Scouts barn is not Considered, they can save that. 00:42:59,840 S1: But wondering what they're offering the Boy Scouts, if anything? 00:43:02,920 S2: Oh, I don't know. I don't know. 00:43:04,440 S1: Yeah, because it's pretty. Best group of kids. It'd be nice if they had. Yeah, a facility. 00:43:12,719 S2: I don't know that they got into that. I think everyone has it in the back of their mind. Yeah. 00:43:19,000 S7: Oh, there's the rec center. They could definitely use it for Boy Scouts. 00:43:21,880 S8: Yeah. 00:43:22,199 S7: Be healthier than that current building. 00:43:24,119 S1: I'm certain that's true. Although it's so fun to go to one. Um, okay. And then the last. Thank you for that. And then the last item is, uh, meeting minutes, which we didn't get. So we're not going to want to table those tonight. Yep. And then if there's anything else people have that they want to talk about, um. 00:43:47,320 S1: That I've made or. 00:43:49,719 S8: I have one thing. This isn't necessarily us, but it just happened in the past couple of hours that, um, more recycling bins were delivered. Yeah, yeah, I know, two. 00:43:58,780 S1: Beautiful. 00:43:59,300 S8: Ones. I already have recycling bins. Right. And these are. 00:44:02,980 S2: Not my department. 00:44:03,860 S8: These are. Those things are huge. 00:44:06,059 S1: They're enormous. And you don't have room for them. And we don't need to. We have the same problem. 00:44:11,219 S8: This is Steve aware of this? I don't know, he, like. 00:44:14,860 S7: Is. But right now. 00:44:15,900 S2: He will be. I'm here by tomorrow. 00:44:17,980 S1: Yes, he will. 00:44:19,300 S2: Because he will be. He'll be okay. He's probably getting phone calls now. Um, yeah. I'm not. I'm not aware of what's happening with the the trash and recycling. 00:44:27,579 S1: The the family on border and foster has two in the front yard of one of the side yard. And they had one already. So like, more than just an extra one and they're not there. They didn't. 00:44:42,699 S2: Like one. 00:44:44,179 S1: So anyway do they need to come back around and pick up the extras. 00:44:48,260 S2: Okay. So yeah, I can let I'll. 00:44:52,059 S1: Let. 00:44:52,340 S2: Steve, the town administrator, know. I'm sure if you've seen it, other people have seen it and maybe call me. 00:44:58,159 S6: I just I turned down my street at it was like 530 and all of a sudden they had appeared. Really? Yeah. 00:45:04,519 S2: Okay. Is it everybody on your street's gotten one. 00:45:07,079 S6: Pretty much any. 00:45:08,440 S1: Good, as I said. Got him order and fostered there. He's got two here and one here. 00:45:14,280 S2: So it's got to be a miscommunication with them. 00:45:16,760 S6: And then. 00:45:17,159 S2: Put it up in. 00:45:17,679 S1: Here. And we got. 00:45:18,440 S6: Them in my driveway so we couldn't even pull anyway. That was like somebody stolen a large. 00:45:24,679 S7: They put them like hat in the road. So people were okay. 00:45:27,719 S6: Like how many are getting hit? Yeah, I was hit like three on the way down here. Like they let them down. 00:45:33,480 S1: We got ours. We got ours two weeks ago. And we're like, what is this? Right, right. 00:45:37,960 S2: This is so this is new for one of these big bins. 00:45:41,079 S1: We had medium sized bins before. 00:45:43,719 S2: Where they. 00:45:44,679 S7: Provide our own self collection. 00:45:46,119 S2: But you have to provide your own. 00:45:48,280 S6: Oh, I help collecting with the truck and pick it up. 00:45:51,679 S1: Yes. 00:45:52,159 S6: Yeah. And I think we're limited to that one. Yeah. 00:45:55,070 S7: You can't. 00:45:55,909 S6: You can't put things on the road. Yeah. 00:45:59,030 S1: Yeah. No, we can't put the old one out. And then the new one out. So it's cleaning out his face because we're doing it. 00:46:06,989 S6: You're you're limited to one. It's going to be just a new one. 00:46:11,230 S1: You if you let me. Right. You can't put the old one out. You have two of the new ones of those goalposts. 00:46:16,909 S6: Yeah, but they. 00:46:17,429 S1: Will likely get. 00:46:18,389 S7: New ones for everyone. 00:46:19,630 S6: Now. 00:46:20,349 S7: For all. 00:46:21,070 S1: That's true. He's got three in front of me. Because obviously they can take three out from one property neighbours. And we're no room for the South. Yeah. All right. So that's it. That is it for this evening? Yeah. All right. I need a motion to adjourn until August 12th. 00:46:40,150 S6: Well, I move that we adjourn till August 12th at 7 p.m.. 00:46:42,829 S1: Okay. And then on August 12th that I date for the next meeting. Yeah. 00:46:47,829 S6: Second. 00:46:48,670 S1: Okay. All in favor? 00:46:50,789 S6: Aye. All right. J.
