Clock got all our technical stuff fixed, Hopefully and we’re good to go. Um, this is the Hamilton, Mass Zoning Board of Appeals meeting for June 5th, Uh 2024. Uh, today or this evening. We have Three projects. We’re gonna go through and a couple of interviews of people who are interested in joining our board. Uh, as an alternative. And and he knew, uh, meeting me and and anything. Knew that somebody might have to add. Um so first of all, today we have a public hearing for the applicant is Andrew McFarlane. The application is for the property located at 59 Russ Street sessions map 55 lot 156, owned by Mark and Catherine Caro. The applicant is seeking a finding under zoning by law section 5.3 0.4 0.5 for dimensional relief from side yard setback requirements to build upon the existing footprint. The. Next. One we will do is continuation of a public hearing. Uh, the pro applications for the property owned by David and Ashley Forster for the property located at 68. Union Street says map 55 lot 213. Applicants are seeking a finding under zoning bylaw section 35.3 0.4 0.5 for dimensional relief for sigh and front yard setback requirements on a lot with a double frontage. In order to connect a garage. To house and create living Space bedroom hall. Five and a variance under section four dimensional and density regulations. For a lot coverage, which currently sits at 23.5 0.6 Sorry, and the proposed is 27.7 and our maximum. Bylaws 25% And, then third item is a continuation of a public hearing for the Application for the Comprehensive permit under Massachusetts general bylaw. General laws chapter 40 B. Sections 20 to 23 for a portion of the property at 133. Essex Street says map 65 Lot one submitted by Chappell in the Chapel Tobacco Hill Capital Partners, LLC. The applicant seeks authorization to construct 59 Mixed income Age Restricted residential Units for residential for sale units in 32 buildings. Um And. Then again, the the Uh, interview with a couple of interested parties for the position here. Uh, right off the bat. I think I’ll just Say that we, um continue. The 133 Essex Street projects. Um, last meeting, it was continued to the July meeting. So if anybody’s here for that. There’s gonna be no discussion about that project. Uh, So. Um we’ll just continue that. Uh, into next meeting. And. Uh so I guess we can start with, um 59 Russ Street project. Uh, we have Andrew McFarlane come up and Discuss what you Plans are please Oh, first before you do that, I should say. Um We do have Andy Phillip here. And Steven Durocher it to my right as a members of the board. Um Our alternative. Dave par in chief. I had to leave. But he’s He can Listen in on zoom later, if he if he wants to. Um, OK, so What. Do we have going. We’re gonna be doing an addition on the back of 59 Russ Street. Um and we’re looking for Relief from the side edge. Um It’s about 8 ft. On, the left side and about 4 ft on the right side. So If you see on the plans on the back of the building. There’s a one story Let’s see. If you have this plan up? There’s a one story, uh, office on the back, and we wanna put a better on top of that. So. It’s about 12 ft. By 23 FT. We’re gonna keep the roof line. Same height as the existing roof line of the second story. Um Bedrooms will be staying the same. Same count. Same count. Yeah, so we’ll be taking over one smaller bedroom, turning that into a master closet. And then Adding a master bedroom and bathroom. Mm. Um So. Basically. All the construction is Within the footprint of the existing footprint just going up on the second floor, Correct lying the roof line, OK? It’s a pretty Straightforward project and the roof line of the addition isn’t any higher than the existing roof line. Right? It’ll have a different pitch, but see, we’re gonna come off the same ridge Ridge will be the same. Yeah. OK, um Anybody from the board have any Comments or concerns. About the proposal. I do not. No. No. OK, Uh, I don’t either. It’s it’s uh Pretty standard for what we allow here. You’re not increasing any encroachment at all or building within what you is already there as a footprint, you’re not adding square footage to the lot so Um I. Guess I will M. Her motion to Vote on the Um Application for the property at 59 Russ Street, such as map 55 lot 156, owned by Mark and Katherine Carle O. To, um Except the finding that There is no um Hardship or or not hardship on any. Um um Extra What. Do. They look forward to, um Uh, maybe If there’s a butters. We should ask if Oh, that right, sure forgot about that. There’s no one online. OK is anybody in a in a crowd. Oh, you are OK. You are a butter. You said you weren’t Oh, you were joking. Sure. Well for Can, you please come to the stadium, set your name and and, uh I thought said earlier. You weren’t you were joking. I. I’m. I’m Rosie Kennedy I live at 61 Rush Street. I’m gonna butt her to the project and I have some questions about the the plans that I’d like to have answered. Please. OK? Please. Yeah. OK. So. My question is, Um, obviously I know the property? Well? Um where exactly How Far out. Are! You planning to go. There’s a. There’s a sun porch down. Uh, is that going to be affected? So? Yeah, there’s a little sun porch on the back. Um, that’s not gonna be affected at all. So just over That existing the roof. OK. Yep. Yep, and it’s gonna be Oh. It’s gonna be just another gabled roof, OK? And That’s what I look like from See Side. That is it’s like the D their driveway side if you were to look at just the other side, then Yeah, OK OK, your side will look. Uh, similar to that. OK. So the the height of the roof line will be. Did You say it was going to be increased. It will be increased. It’ll be the same height as like the existing roof line. OK, that’s fine. OK. That’s fine. Um, OK and so I. I saw you dimensions of 12 by 23 ft. Where’s the 23 ft, So let’s see. Is that weird. That’s the OK, good because I got a little panicky 1 23 ft. So yeah, this Is the 12. That’s the 23 across this way, OK? Um, OK. So. Um it is literally like Just a very short distance from my bedroom and I’m wondering if you could make some accommodation to not start the construction at 7 A.m.. Would you be able to start a little bit later. OK, um Yeah. We’re usually eight or 830. Typically. OK, that’s that’s fine and you’ll bring coffee for the neighbors. OK OK. OK. OK, So. Um, it’s for the baby. How. Can. I object. OK, So I’m. I’m Fine. I just wanted to have that clarified. Thank you so much. OK, thank you. Okay. Nobody’s on zoom for any questions. Anybody else. OK, what’s up? Can you see on zoom? I. Can Yeah, Uh, do you want me to promote you to a panel? Okay, so entertain the vote to approve this as We’ve discussed, Um Since. It’s not, um, substantially more detrimental than the existing non conforming Structure. I set a motion to approve 59 Rush Street. OK, OK. And I. Let’s do a roll call vote Andy Andy Philip. I Steven Durocher I Bruce Grick eye So I have 14 days to write the decision. Um, gets filed with town clerk from that time on you have 21 days of an appeals period case. Somebody comes out of the blue and Wants to, uh Discuss it further. Um And then after that, you’ll get notified and and you’ll be able to start your work. All, right. Thank you very much, and that’s it. All right. Thank you. OK, uh, the next item. On the list. Is for the property at, um What is it 68 Union Street? Uh, we have Reached out to the the applicants to find out what their next step was. We continued it from last, uh, meeting last month, and, um Since. We haven’t heard anything The Building department hasn’t heard anything from them. One way or the other. When. Just. We continue this project until next month, and if then we don’t hear anything. We can Make a decision. On the project. Um What. Our next step is So I, uh, entertain a vote to continue this project to next week or next month. I. Entertain him. I. I Set a motion a motion to continue 68 Union Street into next month. I second that motion. OK? Roll call vote. Indie Philip, I. Stephen Durocher, I Bruce Ginger guy. So. We’ll hopefully hear from them between now and next month. And so that clears up our three major items. Um Then we have, uh, two people interested IN. Joining our board. We have one opening as an alternative. Um So one Let’s see. Yeah. So. I guess we’ll a both people here. And. Then we met one and there’s the other OK? So top of my list. Not Any real order. It’s just Thomas Shams. Could you come up and introduce yourself and Go from there. Good evening, Tom Shamshak from 18 Crescent road here in Hamilton. Uh, I’m actually gonna, uh, withdraw my interest. I’ve spoken with the other applicant due to some availability issues I may have to do to my work schedule miss more than one or two meetings throughout the course of a couple of months, So I don’t wanna, you know, tie anything up or hold anything up with voting, But? Um, I’ve lived in town since 2010 2 young Children that are gonna be going into the public school system this fall. We’ve been a magical beginnings for the past five years. Wonderful town, and, uh, thank you all for what you do. Alright. Thank you. Thank you. Yeah. Yeah, I Quit your real job. Come on. Mm. OK and the other person is Michael Madden. How you doing? Thank you. Um Hello Michael Madden. I live on Highland Street 231 Highland Street. I moved to Hamilton. Let’s say we purchased the property in September of, um 2009 And moved into the house. In march of 2010. So. I. Guess. That’s uh, 14 14.5 years or so, um I know what else to tell you. I’m married. I have three young kids. I’ve got one in elementary school one in the middle school and one in the high school. Um, I work as a project manager. Um I. I currently work at Northeastern University in Bve College of health Sciences. Um, I’m interested in in the position because you know there’s a lot of things going on in the town. And, you know, I, keep my eye on this and I know a lot of people do a lot of work. Um They volunteer for and, um it’s not always nice. It’s not always appreciated, I think, um, and I’d like to help out. So that’s why I I was interested. Have you been involved in any other boards through a town or I was a mean some A few years ago. I was part of this, Um, the Town Hall building committee. Because I was offering You know some services there for project management, um, which they have to get an M and owners project manager. I understood. Um, but I was involved for a little bit with that. But other than that, no. Yeah. Yeah. Um, you guys have any questions? Uh are what are you interested in with like properties and like property law property. Uh, the Any any background any interest in learning more about real estate property? Bylaws. Yeah. Down politics. I have when I was on the website, and there’s a lot of information there and a lot of Bylaws and so forth. But. I’m. I’m. I’m very interested in, uh, also from a project management perspective because construction project management is a is a big deal. Um, I don’t know a lot about that. Uh, no, a little bit about it, but not as much as I would like to. So from that perspective, Yeah. Yeah most most of our projects are like what you heard this evening. You know small additions that are Smaller lots. Predating. The zoning bylaws, uh, creation, so we have to go through that quite a bit. Um We do have obviously the bigger one coming up with, uh, the 133 Essex Street. Um And But we don’t have Not a whole lot of excitement in this town, so a little bit, but Um You know that’s that’s we’re we’re pretty Mhm. Pretty straightforward board. I think so. There is a lot of stuff going on in town. As of late, though, and I feel like a lot of folks are getting more interested in participating in, uh, municipal processes. Uh, as a result, so I’m curious if there’s anything specific in addition to your kind of desire to Um, get acquainted more with the process. Anything specific about Uh, the zoning Board of appeals or or anything that that we deal with which is usually mostly You know, approving non conforming decks and additions. Uh, but occasionally, uh, 40 B projects and, um Yeah? No, nothing in particular. I mean I know there’s a lot of things going on. Excuse me a lot of things going on in town. It’s more my interest. Um And I have been going to a few meetings lately. Um, but it’s more my interest in Helping out with the town, you know? I think we need a lot of help, and I think it’s a great thing that more people are getting involved and that we’re hearing all sorts of different opinions. Um, because you know, I’ve gone to other meetings in the past, and I was the only person sitting out there. I’ve gone to town meetings, too, and it’s like 10. People make the Um Pass. Regulations, laws, regulations for the whole of the town, which is really a shame so You know, I think it’s good that we’re getting to hear from more people. Um, so yeah, it’s just a Interest interest in helping out more. Thank you. Okay, Um I. Suppose. You’re the only person who’s interested in this Well. We have two people interested, but one decided it’s probably Not. Good for his schedule. Um We can, if if I suppose we could vote on News becoming a member, then we have to give it to the the The Select board to to review that, Um I. Don’t know if we’ve Vote on it, or we just make a recommendation. I’m not sure how this works. I can’t remember. I. We have a select board member. We could probably ask her. Oh. Maybe. Rosie, do you know OK? It can be either. Um, The planning board is So did I somebody voted to recommend That that person for What do you call alternate position so you could Yeah. Yeah. Okay, well, let’s let’s do that. Then, um I set a motion to I’m sorry. Uh, I’m looking up your full name. Do. You have the full name. What’s that do you have his full name? His Applicant. Michael Madden. Oh, sorry. Yeah. Do you do it? I set a motion to or I. I, uh, recommend a motion to approve Michael Madden as a select board next step interview for the zoning Board of Appeals. Alternate position. I second the motion. And. I heard that motion. Um so we will That. We don’t need to. We need a vote on matter much. We’ll vote on it, OK? Steven Durocher I Bruce ginger eye, So, we’ll I’ll. I’ll write a recommendation letter to, um The. There’s a, uh, the Planning board and and or the Psych Ward Select board, and, uh, Right. It’ll be in their hands. Great. Thank you very much appreciate it. All right. Thank you. Um That. The other thing we have is the Meeting minutes. Review, uh from the main meeting. Um Do. We have any comments on that? Any clarifications Anybody like to make That seem pretty Solid to me as far as the meeting minutes. Go. Can’t read it Now. My name’s What’s that, he said. My name is spelled, right? Oh, OK. If. We have no no concerns on it or any edification We wanna do, Um Motion to approve the Um Meeting minutes of May 1st 2024 Are we Approve the meetings from meeting minutes from May 21st may 1st 2024 Okay? OK, I heard it. Andy Philippi. Steven Derocher I Bruce King, your eye. And that Wraps it up. Um So. I entertain a motion to adjourn this meeting. Is there. One more thing under regular business where it says old business to vote to amend. Drive me updates from the chair. I don’t see anything else on the I’ll be sharing the, uh, the digital version. There is the vote to amend the decision for the application submitted for 89 Green Book Road. Uh, owner Linda McMahon due to a Scrivener’s error so that it is the decision clearly states that the board approved a finding under zoning bylaw section 534 for dimensional relief for side yard setback and a special permit under zoning by law, 3.6 for an accessory apartment, which the board did approve during the May 1st 2024 regularly scheduled meeting as the project as shown in the video of the meeting and the draft meeting minutes due to the fact that the vote is still In approval for a finding. And a special permit the chair will bring And updated decision to attach to the decision, which has been on file With the office of the town clerk. On May 7th I did not see that I didn’t get that one in. Maybe. I didn’t get the updated Uh, agenda. Um You wanna You wanna take a look? So Yeah, Let me take a look at that real quick. Uh, old business. Yeah. So I got, I suppose we just need to Vote on the amendment. Still an approval for something Um okay. Not Exactly Sure. What the The the or decision It was written to the accessory apartment. Um Digital fact that the vote is still in Approval for a finding. And a special permit. The chair will bring an updated decision. To attach to the decision, which has been on file With the office. OK we just need to vote to approve. The amendment. Yeah. I makes the decision. Say what we actually approved in the meeting. Yeah. OK. This is the first. This was the first applicant from last meeting. If that helped jogs your memory at all. It was a pretty good from what I. Remember. It was a pretty quick conversation. Yeah. Okay. So I. I guess I’ll motion to vote or or entertain a vote. A motion to vote on The Amendment for the decision, as has just been read for read for 89 Green Brook Road. I set a motion to clarify the error that we did decide. To approve this project. I second the motion. Okay, Um And. I agree also so The Roll Call Vote and Philip Steven Deroche or I, Bruce Kenrick eye So make sure that that gets done Um Since I. Haven’t seen it Somebody Not exactly Sure what needs to be done, but I I’ll get it done. Um, just to clarify it. Okay. Motion to adjourn. Sure. My third Andy Philip. I derocher
